Jeffrey S. Patterson is a partner of Nelson Mullins Riley & Scarborough LLP and practices in Boston in all areas of business, employment, and consumer finance litigation.  Mr. Patterson began his career in the Firm's South Carolina offices gaining significant experience in the representation of businesses as both plaintiffs and defendants in complex commercial disputes.  Mr. Patterson has represented companies in litigation with consumers and other businesses in state and federal courts in Florida, Georgia, North Carolina, West Virginia, South Carolina, Tennessee, Pennsylvania, Missouri, Illinois, New York, Massachusetts, and California.  Since relocating to the Firm's Boston office, Mr. Patterson's litigation practice has focused on consumer finance, banking, and insurance issues, and he has been selected for inclusion in the 2012 edition of The Best Lawyers in America for Commercial Litigation.

In addition to Mr. Patterson's trial experience, he has also handled a number of appellate matters in both the state and federal courts.  This work has resulted in the following reported decisions spanning a range of legal areas from consumer financial services to the Federal False Claims Act:
 
  • Melfi v. WMC Mortgage Corp. et al., ____ F.3d ____ No. 09-1066 (1st Cir. 2009) -- decision affirming dismissal of borrower rescission claims under the Truth in Lending Act
  • Sonoco Products Company v. Physician's Health Plan, Inc., 338 F.3d 366 (4th Cir. 2003) — decision explaining the bounds of the complete preemptive effect of Employee Retirement Income Security Act
  • United States ex rel. Becker v. Westinghouse Savannah River Company, 305 F.3d 284 (4th Cir. 2002) — decision applying government knowledge defense under Federal False Claims Act to affirm summary judgment
  • Carolina Care Plan, Inc. v. United Healthcare Services, Inc., 606 S.E.2d 752 (S.C. 2004) — decision addressing enforceability of arbitration clause in complex business dispute
  • RWE Nukem Corp. v. ENSR Corp., ___ S.E.2d ___, Op. No. 26320 (S.C. 2007)—overturning trial court ruling on statute of limitations

Mr. Patterson is admitted to practice before the U.S. Circuit Court of Appeals for the First and Fourth Circuits, the U.S. District Courts for the Districts of South Carolina and Massachusetts, and all levels of the state courts in South Carolina and Massachusetts.  Mr. Patterson is a member of the American Bar Association and the Defense Research Institute. 

In 1995, Mr. Patterson earned a Juris Doctor from the University of South Carolina School of Law where he received American Jurisprudence Awards for Legal Writing and Trusts and Estates. He was a member of the Order of Wig and Robe and Phi Delta Phi, served as vice president of the Palmetto Law Society, and was twice named to Who's Who Among American Law Students. Mr. Patterson earned a Bachelor of Arts in History and Political Science from Furman University in 1992.

During his years of practice, Mr. Patterson has been involved in both bar activities and public service.  He twice served as the State Chairman for Volunteer Recruitment for the Young Lawyers' Division of the South Carolina Bar.  In 2004, Mr. Patterson co-authored the chapter on "Contract Damages" for the South Carolina Bar's treatise on South Carolina Damages.  In 2005, Mr. Patterson accepted an appointment by the Governor of South Carolina to serve on the Board of Governors for the South Carolina Patient Compensation Fund which provides excess coverage for health care providers throughout South Carolina.  Mr. Patterson has also served on the Board of Directors for the Palmetto Chapter of the Juvenile Diabetes Research Foundation.
