E-Discovery and Litigation Readiness
Our e-discovery and litigation readiness lawyers combine our experience in developing defensible e-discovery readiness strategies as national e-discovery counsel for Fortune 100 corporations with experience as national coordinating counsel in large-scale litigation. Proactive litigation readiness is necessary in the current litigation environment, and our lawyers provide pre-litigation data mapping, assistance with retention policies, threat assessment, meet-and-confer preparation, and other readiness services for some of the largest corporations in the United States. We integrate litigation readiness services into broader information management programs that we have developed for our clients. Our lawyers also implement preservation and collection efforts, manage substantial document review projects, and assess e-discovery technology. Other representative Nelson Mullins e-discovery readiness projects include:
-
developing and implementing document review strategies;
-
initial assessments to identify realistic risks in existing preservation and collection procedures;
-
implementing appropriately scaled enterprise data mapping strategies to prepare for meet-and-confer obligations;
-
developing cost reduction and RFP projects for companies seeking to establish preferred electronic discovery vendor relationships;
-
acquisition, implementation, and defensibility testing of enterprise-wide search and retrieval tools;
-
development of efficient and defensible remote, desk-side and network-level collection procedures utilizing both in-house and outsourced personnel;
-
development of preservation and collection strategies for emerging ESI data sources, including voice-mail, instant messaging, outsourced data hosts, PDAs, and other portable storage devices;
-
selecting and preparing Rule 30(b)(6) deposition witnesses for ESI infrastructure and data collection issues;
-
developing best practices and requirements for the coordination of outside counsel on e-discovery issues to facilitate consistency, defensibility, and efficiency; and
-

Complementing our practical experience is our leadership of national organizations devoted to e-discovery issues. For example, our lawyers include leaders of the Defense Research Institute’s E-Discovery Committee and the General Counsel of the Corporate E-Discovery Forum. Several Nelson Mullins lawyers are actively involved in other thought leadership groups and associations such as the Sedona Conference, ARMA, and the E-Discovery Committee of the Center for Public Resources.
